JET SKI RENTAL LIABILITY WAIVER AND DAMAGE AGREEMENT

This Jet Ski Rental Agreement and Liability Waiver (the "Agreement") is made and entered into on [Date], by and between LITE WAVE WATERSPORTS LLC, ("Owner") located at 1631 DEL PRADO BLVD S STE 300 CAPE CORAL, F.L. 33990, and the undersigned renter ("Renter").

 

1. ASSUMPTION OF RISK AND LIABILITY WAIVER

1.1. Renter acknowledges and understands that operating a jet ski involves inherent risks, including but not limited to personal injury, property damage, and potential loss of life.
1.2. Renter voluntarily assumes all risks associated with the use of the rented jet ski and agrees to hold the Owner, its employees, and affiliates harmless from any and all claims, liabilities, damages, or expenses arising from Renter’s use of the jet ski.
1.3. Renter agrees to operate the jet ski in a safe and responsible manner, adhering to all local, state, and federal laws, as well as any instructions provided by the Owner.

 

2. DAMAGE RESPONSIBILITY

2.1. Renter agrees to return the jet ski in the same condition as when received, normal wear and tear excepted.
2.2. Renter is fully responsible for any and all damages, losses, or theft of the jet ski, its equipment, or accessories occurring during the rental period.
2.3. In the event of damage or loss, Renter authorizes the Owner to charge the full cost of repairs or replacement to the credit card provided at the time of rental.

 

3. AGREED UPON RIDING AREA

3.1. Renter agrees to operate the jet ski only within the designated riding area as defined by the Owner at the time of rental.
3.2. If venturing outside the agreed-upon riding area results in damage or loss of rental equipment, renter agrees to additional recovery or towing fees if the jet ski must be retrieved.
3.3. Renter understands that failure to remain within the designated area may result in early termination of the rental without a refund.
3.4. The Owner reserves the right to track the jet ski via GPS or other means to ensure compliance with the designated area.

 

4. SAFETY REQUIREMENTS

4.1. Mandatory Safety Equipment: Renter must wear all safety equipment required by state law, including but not limited to life jackets and kill switches, at all times while operating the jet ski.
4.2. Responsibility for Equipment: The Owner is not responsible for the removal, loss, or misuse of any safety equipment during the rental period. It is the Renter’s responsibility to ensure compliance with all safety regulations.
4.3. Safety Video Requirement: Renter must watch the Owner-provided riding and safety instructional video at least 30 minutes prior to the rental start time.
4.4. Failure to Complete Safety Video: If the Renter fails to watch the required safety video before the scheduled rental time, they will not be permitted to use the jet ski, and the full rental charge will still apply.

 

5. TIMELY RETURN POLICY

5.1. Renter agrees to return the jet ski at the designated return time to ensure that subsequent reservations remain on schedule.
5.2. Failure to return the jet ski on time will result in a $10 late fee for every 5 minutes past the designated return time, which will be charged to the credit card on file.
5.3. If the jet ski is more than 30 minutes late, the Owner reserves the right to consider the watercraft lost or stolen and take appropriate action, including but not limited to charging for the full replacement value and reporting to law enforcement.

 

6. CREDIT CARD AUTHORIZATION

6.1. Renter agrees to provide a valid credit card at the time of rental, which will be kept on file for the duration of the rental period and post ride inspection.
6.2. Renter expressly authorizes Owner to charge the credit card on file for any damages, repairs, losses, surcharges, late fees, or additional fees incurred, including but not limited to fuel charges, cleaning fees, or out-of-area violations.

 

7. RELEASE OF LIABILITY AND INDEMNIFICATION

7.1. Renter releases, discharges, and agrees not to sue the Owner, its officers, employees, or agents for any injuries, death, damages, or losses sustained while operating the jet ski, even if caused by negligence.
7.2. Renter agrees to indemnify and hold harmless the Owner from any claims, demands, losses, or damages, including legal fees, arising out of Renter’s operation or use of the jet ski.

 

8. RENTAL TERMS AND CONDITIONS

8.1. Renter must be 18 years old and possess a valid Drivers License.
8.2. Renter shall not operate the jet ski under the influence of alcohol, drugs, or any substances that may impair judgment.
8.3. Renter is prohibited from allowing any unauthorized person to operate the jet ski.
8.4. Failure to return the jet ski at the agreed-upon time will result in late fees as outlined in Section 5.

 

9. ACKNOWLEDGMENT AND SIGNATURE

By signing below, Renter acknowledges that they have read, understood, and agreed to the terms of this Agreement. Renter also confirms that they will inspect the jet ski and confirm it's condition prior to rental.
